PROMOTION TERMS AND CONDITIONS OF ENTRY

Effective date: January 1st, 2024

The Good Friend (“us”, “we”, or “our”) operates the https://thegoodfriend.com.au website (“the Site”).

This page informs you of our Terms & Conditions regarding Promotions on our site.

The Good Friend Australia Pty Ltd (ACN 668 765 624) of 18 Hotham Street Traralgon, Victoria (the Promoter), is conducting a trade promotion (the Promotion) for individuals (Entrants).

THE PROMOTION:

1. 1. The Promotion Period will take place monthly.
   2. The Promotion is a game of chance.
   3. Promotion prize winners will be selected at random via electronic draw from all valid entries (Entries) received during the Promotion Period (Promotion Draw).
   4. The Promotion Draw will take place at 540 Traralgon-Balook Road, Callignee, Victoria.
   5. The Promotion Draw will be conducted live online, via the Promoter’s lnstagram account at https://www.instagram.com/thegoodfriend23/ on the first day of each calendar month during the Promotion Period at 6pm.
   6. Entry into the Promotion is deemed acceptance of these terms and conditions (Terms and Conditions).
   7. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Promotion, these Terms and Conditions will prevail.
   8. The Promotion shall be governed by, and conducted in accordance with, Victorian law and is subject to the exclusive jurisdiction of the Victorian courts.

ELIGIBILITY:

1. 1. Entry is open to all Australian residents aged 18 years or older who are members of the Good Friend Membership Platform (Members), except employees and immediate families of the Promoter and any of their companies and agencies associated with this Promotion.
   2. To be eligible for the Promotion, Entrants must register for and maintain a valid membership of the Good Friend Membership Platform (Membership).
   3. Entrants with a valid Membership will be automatically entered into the Promotion.
   4. Members with a valid Membership will automatically receive a number of entries into the
      Promotion in accordance with their Membership tier as follows:

a. Good Friend – three (3) entries;
b. Fun Friend – nine (9) entries;
c. Best Friend – twenty five (25) entries; and
(collectively the Standard Membership Entries).

1. 1. Loyalty Bonus

a. In addition to the Standard Membership Entries, Members will receive bonus entries for each month of continuing valid Membership as follows:
i. Good Friend – three (3) bonus entries;
ii. Fun Friend – nine (9) bonus entries;
iii. Best Friend – twenty five (25) bonus entries; and

(collectively the Bonus Membership Entries).

1. 1. Entries to the Promotion will open on the first day of each calendar month during the Promotion Period and will close on the last day of each calendar month during the Promotion Period.
   2. The Promoter reserves the right to verify the eligibility of Entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until the Promoter is satisfied with the verification.

THE PRIZES:

1. 1. Prize – details of the prize can be found at https://thegoodfriend.com.au/prizes.
   2. The winner of the Prize (Winner) will be announced on the Promoter’s website at https://thegoodfriend.com.au. within 24 hours of the Promotion Draw.
   3. Winners will be notified via phone and email immediately after each monthly Promotion Draw.
   4. Winners will also be published online immediately after the Promotion Draw via the Promoter’s social media platforms and published on the Promoter’s website at www.thegoodfriend.com.au for a minimum period of 30 days.
   5. Entrants agree to their initials and postcode being published as part of the Promotion Draw announcements.
   6. The Promoter will deliver the prize within 28 days of the prize being awarded to the address provided by the Entrant at the time of registration of the Entrant’s Membership.
   7. If the prize remains unclaimed after the expiry of three months, an unclaimed prize draw may be conducted. The Winner of the unclaimed prize draw will be notified and published in accordance with clauses 17 to 19 above.
   8. The Promoter takes no responsibility for an incorrect address, or contact details being provided by the Entrant.
   9. The Promoter is not liable for any prize that has been lost, stolen, damaged or tampered with in any way.
   10. Prizes awarded are final and are not interchangeable and cannot be redeemed for cash.
   11. Where a Prize is unavailable for a reason beyond the reasonable control of the Promoter, the Promoter reserves the right to provide a substitute prize of equal or greater value.
   12. Prizes are subject to any additional terms and conditions imposed by the relevant supplier of the Prize or the Promoter, including but not limited to, validity and expiration periods.
   13. Any ancillary costs incurred as a result of taking the Prize are not included in the Promotion or Prize and are the responsibility of the Winners.

ENTRANT OBLIGATIONS AND ACKNOWLEDGEMENTS:

1. 1. The Entrant represents and warrants that it shall not contact any affiliate, employee, sponsor or partner of the Promoter in order to manipulate or otherwise interfere with the Promotion Draw.
   2. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The legal rights of the Promoter to recover damages or other compensation from such an individual are reserved.
   3. In the event the Promotion is compromised by tampering or other causes beyond the reasonable control of the Promoter, that corrupt or impair the administration, security, fairness or proper operation of the Promotion, the Promoter reserves the right to suspend, modify or terminate the Promotion.
   4. Any attempt by an Entrant to deliberately damage the website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, the Promoter reserves the right to seek damages from any such Entrant to the fullest extent permitted by law.

DISCLAIMER:

1. 1. The Entrant agrees that:

a) Any and all disputes, claims and causes of action arising out of or in connection with the Promotion and the promotional prizes shall be resolved individually without any form of class action;
b) Any claims, judgments and awards shall be limited to actual out of pocket costs incurred in entering the Promotion, but under no circumstances will the Promoter be responsible for any legal fees;
c) Entrants hereby waive all rights to claim punitive, incidental or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the Promotion;
d) In no event will the Promoter, their licensees, parents, affiliates, subsidiaries and related companies, their advertising or promotional agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from access to, or use of, this website, electronic or computer malfunctions, or Entrant participation in this Promotion, even if the Promoter was advised of the possibility of such damages.
e) The Promoter assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service provider, or email systems, the failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.
f) The Promotion is void where prohibited or restricted by law.
g) The Promoter reserves the right to suspend, modify or terminate the Promotion where, in the opinion of the Promoter, the administration, security, fairness or proper operation of the Promotion has been prejudiced or compromised.

GENERAL:

1. 1. In consideration for the Promoter awarding the Prize to the Winner, the Winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the Winner’s participation in/with the Prize to appear in advertising or marketing thereof, in any media whatsoever throughout the world and the Winner will not be entitled to any fee for such use.
   2. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the ability of the Promoter to proceed with the Promotion on the dates and in the manner described in these Terms and Conditions, including but not limited to forces of nature, natural disasters, acts of terrorism, riots, revolution, civil commotion, epidemic, industrial action and action or inaction by a government agency, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any directions given under State regulation.
   3. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (Vic) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.
   4. The Promoter is not responsible for any incorrect or inaccurate information, either caused by Entrant or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

PERSONAL INFORMATION AND PRIVACY:

1. All entries become the property of the Promoter. The Promoter collects personal information about Entrants for the purposes of conducting this Promotion and its future promotional activities. Any disclosure of such information will be made as required by law and in accordance with these Terms and Conditions but no further use of this information will be made without prior consent. If Entrants no longer consent to their details being used for this Promotion or future marketing activities, the Entrant can unsubscribe at any time by changing the settings through their Member profile on the Promoter Site or by contacting the Promoter by email at support@thegoodfriend.com.au.
2. The Promoter uses and handles personal information gathered from this Promotion as set out in its Privacy Policy, available upon request and via https://thegoodfriend.com.au/privacy-policy.
